Suburb Says Terms of Use

Welcome to Suburb Says.

These Terms of Use explain the rules for using the Suburb Says website, AI chat experience, recommendation features, account features, sponsor features and related services.

By using Suburb Says, creating an account, submitting a recommendation, searching for a recommendation, contacting us or using any part of the platform, you agree to these Terms.

If you do not agree, you should not use Suburb Says.

1. Who we are

Suburb Says is a community-led platform that helps people discover local small businesses, trades and service providers recommended by people nearby.

2. What Suburb Says does

Suburb Says helps locals find small businesses that other locals have recommended. We are not a traditional directory. We do not aim to show every business in an area.

Instead, we present a small, curated set of businesses that we have heard genuine positive feedback about from local people, based on recommendation data held by Suburb Says.

Our service may include:

• local recommendation search;

• AI-assisted recommendation answers;

• suburb, cluster and region recommendation pages;

• business recommendation summaries;

• community recommendation collection;

• user accounts;

• sponsor placements;

• email updates and related communications.
   

3. What Suburb Says does not do

Suburb Says does not:

• independently certify, license, insure, audit or guarantee businesses;

• guarantee that a business is suitable for your needs;

• guarantee the quality, safety, price, availability, timing or outcome of any work;

• act as a broker, agent, marketplace, contractor or lead-generation service;

• process bookings or payments between users and businesses;

• employ or supervise the businesses mentioned on the platform;

• guarantee that recommendation content is complete, current or error-free;

• scrape external reviews or rely on online ratings to create recommendations;

• allow businesses to pay to be recommended.
   

You are responsible for making your own enquiries before hiring, paying or relying on any business mentioned on Suburb Says.

4. Eligibility

You must be at least 18 years old to create an account, submit a recommendation or use features that require login. By using those features, you confirm that you are 18 or older and that the information you provide is accurate.

5. Accounts and login

Some parts of Suburb Says may require you to create an account or log in.
You agree to:

• provide accurate and current information;

• keep your login details secure;

• not create fake, duplicate or misleading accounts;

• not use another person’s account without permission;

• not use Suburb Says in a way that interferes with the platform or other users.
   

We may suspend, restrict or remove access to an account if we believe it has been used in a way that breaches these Terms, damages trust in the platform, or creates legal, privacy, safety or operational concerns.

6. Why we ask for local information

Suburb Says may ask for information such as your suburb, street name, contact details or other behind-the-scenes verification details.
We ask for this information to help:

• confirm that recommendations are genuine;

• understand local relevance and proximity;

• reduce fake, duplicate or self-promotional recommendations;

• protect the quality of the recommendation data;

• prevent people from gaming the platform.
   

We do not publish your personal contact details. We do not publish your full residential address. Our handling of personal information is explained in our Privacy Policy.

7. Recommendations submitted by users

When you submit a recommendation, you agree that:
 

• your recommendation is genuine;

• it reflects your honest experience or knowledge;

• you are not submitting false, misleading or exaggerated information;

• you are not pretending to be someone else;

• you are not submitting a recommendation to unfairly promote yourself, your employer, your family member, your client or a business you are connected with, unless that connection is clearly disclosed;

• you will not submit defamatory, abusive, discriminatory, offensive, private or unlawful content;

• you will not include unnecessary personal information about another person.
   

You must not submit fake recommendations, paid recommendations, incentivised recommendations, duplicate recommendations, competitor attacks or content designed to manipulate the platform.

8. Our rights to use recommendation content

When you submit a recommendation, comment, message or other content to Suburb Says, you give Suburb Says permission to use that content for the purposes of operating, improving, promoting and protecting the platform.

This includes permission to:

• review the content;

• verify the content;

• moderate the content;

• edit the content for clarity, length, privacy, tone or legal safety;

• summarise or paraphrase the content;

• combine it with other recommendation data;

• display it publicly;

• use it in AI-assisted answers;

• use it on suburb, cluster or region pages;

• use it in marketing, social media, emails or other Suburb Says communications.
   

This permission is worldwide, royalty-free, ongoing and transferable where reasonably necessary for the operation or transfer of Suburb Says. You still own any rights you may have in your original content, but you allow Suburb Says to use it in the ways described above.

9. Moderation of recommendations

Recommendations are not published automatically.
Suburb Says may, at its discretion:

• review;

• verify;

• moderate;

• edit;

• summarise;

• delay;

• reject;

• remove;

• de-identify;

• combine;

• or decline to publish any recommendation or submission.
   

We may do this for any reason, including where we believe content may be false, misleading, duplicated, unfair, defamatory, unsafe, private, irrelevant, low quality, self-promotional or inconsistent with the purpose of Suburb Says. We are not required to publish any recommendation.

10. What may be published

If a recommendation is published or used in a recommendation summary, public content may include:
 

• the recommended business’s name;

• business category;

• suburb, cluster or region;

• business contact details;

• number of approved recommendations;

• themes or summaries from recommendation comments;

• selected comments or paraphrased comments;

• limited recommender attribution, such as first name and suburb, where appropriate.

We will not ordinarily publish a recommender’s:

• surname;

• email address;

• phone number;

• exact residential address;

• login details;

• IP address.
   

We may remove or further de-identify information where we believe publication could create a privacy, safety, legal or fairness concern.
11. Businesses mentioned on Suburb Says
A business may be mentioned on Suburb Says because it has received genuine community recommendations or because it appears in a sponsor placement.

Being mentioned on Suburb Says does not mean that we have independently verified, certified, licensed, insured, audited or guaranteed that business.
Businesses are responsible for their own services, pricing, work, conduct, licensing, insurance, availability and compliance with law.

Users should make their own checks before engaging a business, including checking licences, insurance, qualifications, quotes, references and suitability where relevant.

12. Business correction and complaint requests

Businesses may contact us to request correction of inaccurate business details, raise a concern about published content, or ask us to review a recommendation.

We may review the concern and decide whether to correct, amend, de-identify, remove or leave content unchanged.

A business does not have an automatic right to remove genuine community feedback simply because it does not like being mentioned. We may retain legitimate recommendation data where we believe it is fair, lawful, accurate enough, relevant and consistent with the purpose of Suburb Says.

13. Sponsors and paid placements

Suburb Says may offer paid sponsor placements for suburbs, clusters, regions or other areas of the platform. Sponsorship is separate from recommendation status.

A sponsor cannot pay to be recommended. A sponsor cannot buy its way into recommendation rankings. Sponsor payments do not change the underlying community recommendation data.

Sponsor placements may appear near recommendation content, on local pages, in AI-assisted experiences, in emails or in other Suburb Says placements. Where appropriate, sponsor placements will be identified as sponsored.

Suburb Says may approve, reject, delay, remove or change sponsor placements where we believe this is necessary to protect the platform, users, legal compliance, brand trust or community confidence.
Unless separately agreed in writing, sponsorship does not guarantee:
 

• leads;

• enquiries;

• sales;

• traffic;

• impressions;

• exclusivity beyond the agreed placement;

• recommendation status;

• search ranking;

• ongoing availability of a particular page, format or feature.
   

Separate sponsor terms, order forms, payment terms or written agreements may apply to paid sponsorships.

14. AI-assisted answers and summaries

Suburb Says may use artificial intelligence to help users search, understand and interact with recommendation information.

AI may help us:

• interpret user questions;

• identify relevant suburbs, regions and business categories;

• summarise recommendation themes;

• present recommendation stories;

• detect possible duplicates or suspicious activity;

• improve the user experience.
   

AI does not create the underlying recommendations. The underlying recommendation data comes from community submissions and information held by Suburb Says.

AI-assisted answers may be incomplete, inaccurate, out of date or based on limited available information. You should not rely on AI answers as a guarantee, professional advice or final decision.

15. No professional advice

Information on Suburb Says is provided for general information only. It is not legal, financial, building, safety, insurance, professional or technical advice.
Before hiring a business or relying on information from Suburb Says, you should make your own enquiries and seek professional advice where appropriate.

16. Acceptable use

You agree not to use Suburb Says to:
 

• break the law;

• submit false, misleading, defamatory, abusive or unlawful content;

• impersonate another person;

• create fake or duplicate accounts;

• manipulate recommendation data;

• scrape, copy, harvest or extract data from the platform without permission;

• interfere with the website, database, AI experience or security systems;

• upload malicious code or attempt unauthorised access;

• harass, threaten or abuse another person;

• publish private personal information about someone else;

• damage the reputation, operation or trust of Suburb Says.
   

We may restrict, suspend or block access if we believe these rules have been breached.

17. Intellectual property

Suburb Says owns or licenses the intellectual property in the platform, including the website, branding, design, text, summaries, recommendation presentation, AI experience, page structure and related materials.

You must not copy, reproduce, modify, republish, scrape, distribute or commercially exploit Suburb Says content without our prior written permission, except where allowed by law. You may share links to public Suburb Says pages in a fair and reasonable way.

18. Third-party websites and services

Suburb Says may link to third-party websites, businesses, sponsors, social media platforms, payment providers or other services.
We are not responsible for third-party websites, services, content, privacy practices, availability, pricing or conduct.

You use third-party services at your own risk and should read their terms and privacy policies.

19. Availability and changes to the service

Suburb Says is still evolving. We may change, suspend, remove, replace or discontinue any part of the platform at any time. This may include recommendation features, AI chat features, sponsor placements, local pages, account features, content formats or supported locations. We do not guarantee that Suburb Says will always be available, uninterrupted, secure or error-free.

20. Limitation of liability

To the maximum extent permitted by law, Suburb Says is not liable for any loss, damage, cost, claim or expense arising from:

• your use of, or inability to use, Suburb Says;

• your reliance on recommendation content or AI-assisted answers;

• your dealings with any business mentioned on Suburb Says;

• the conduct, work, pricing, quality, safety, availability or failure of any business;

• errors, omissions, delays or inaccuracies in content;

• unauthorised access, technical issues or service interruptions;

• third-party websites, platforms, providers or services.
   

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under Australian law.
Where liability cannot be excluded, our liability is limited to the maximum extent permitted by law.

21. Indemnity
You agree to indemnify Suburb Says against any loss, damage, cost, claim or expense arising from:

• your breach of these Terms;

• your misuse of the platform;

• content you submit;

• false, misleading, defamatory or unlawful information you provide;

• your infringement of another person’s rights;

• your breach of any law.
   

22. Privacy

Our collection, use, storage and disclosure of personal information is explained in our Privacy Policy.
By using Suburb Says, you agree that we may handle your personal information in accordance with our Privacy Policy.

23. Ending or restricting access
We may suspend, restrict, remove or terminate your access to Suburb Says if we believe:

• you have breached these Terms;

• your account is being misused;

• your conduct may harm users, businesses, sponsors or Suburb Says;

• access needs to be restricted for legal, safety, security, operational or platform-integrity reasons.

You may stop using Suburb Says at any time.

24. Changes to these Terms

We may update these Terms from time to time.
The current version will be published on our website with its effective date. Material changes may also be communicated through the website, user account or email. Your continued use of Suburb Says after changes are made means you accept the updated Terms.

25. Governing law

These Terms are governed by the laws of New South Wales, Australia.
The parties submit to the courts of New South Wales and any courts entitled to hear appeals from those courts.
